Change Immigration Providers in 3 Simple Steps

If the pandemic has taught us anything it's that if your immigration program isn't digital, you're probably scrambling to keep up in 2020. Gone are the days of files and storage cabinets, to keep up with the changing landscape you need an immigration provider that can accurately forecast your needs, respond to audits with access to your files at the click of a button, and help you stay competitive to secure top international talent.

Aila released a report back in 2016 on the future of immigration, "As immigration attorneys become more technologically advanced, so do their clients. And as clients increasingly engage in all areas of the global marketplace, they are expecting a higher level of ingenuity from their legal services provider. This wave of consumers is aptly putting pressure on efficiency, transparency, and cost-effectiveness for the services they are paying for, or they are turning to alternatives to meet their legal needs."

If you're thinking of switching providers, here are three simple steps that can help you make the move:

1. Communication

  • Ensure that effective internal communications are shared with employees to let them know of the change in provider and the new offerings of said provider.
  • Relevant internal departments or stakeholders should also be notified of change in provider such as the accounting department and relevant line managers.
  • Ensure the new provider is aware of current international employees with closed cases. This helps the new provider forecast when visas need to be extended or green-card process should be initiated, etc.

2. Data Privacy

  • Ensure that data will be handled in a responsible and compliant manner. This includes abiding by relevant laws, such as GDPR in Europe and CCPA in California, and general best security best practices such as sending sensitive data in encrypted files.

3. Data Transfer

  • Ensure that data is properly transferred from one provider to another, not losing key actionable data such as visa max-out dates and status expiration dates.
  • Ensure that any current off-platform data can be inputted into the new platform, such as documents and forms.
  • HR should ensure that all documentation relating to current international employees is transferred from old to new provider, whether that be via a platform or sent via mail if hard copies exist (e.g. certified PERMS).
